
By execution of the Subscription Agreement LWFITNESS4ALL LTD
you confirm that you accept the following terms and conditions:
It is your responsibility to ensure that you are capable of undergoing the
activities in any exercise programme and you should take medical advice before
embarking on any exercise programme.
All activities are undertaken at your own risk and under medical advice.
The advice and instructions provided by LWFITNESS4ALL LTD or
otherwise through correspondence or consultation do not in any way replace, and should not be construed as, medical advice.
In subscribing for Personal Training you confirm that:
(a) you are at least 18 years of age;
(b) you are in good physical condition and capable of engaging in exercise;
(c) you know of no medical or other reason why you are not able to engage in active or passive exercise; and
(d) such exercise would not be detrimental to your health, safety, comfort or physical condition.
You should seek the approval from a doctor before taking part in physical
exercise. If during any activity you feel pain, dizziness or excessive
shortness of breath stop exercising and consult your doctor.
LWFITNESS4ALL LTD accepts no responsibility for any loss or
injury incurred during exercise.
LWFITNESS4ALL LTD gives no warranty or representation
and provides no guarantee as to the results of any exercise programme.
LWFITNESS4ALL LTD and its agents, contractors and
employees shall not be liable for any claims, demands, damages, rights
of action or other causes of action, whether present or future, arising
out of or connected in any way to the use of any of the information
provided through a website www.lwfitness4all.com, correspondence or
consultation, including, without limitation, in relation to any injuries
sustained by you except in so far as it can be proven that the relevant
injury relates to the wilful act, neglect or default of
LWFITNESS4ALL LTD or any of its agents, contractors or
employees.
It is necessary for the purpose of providing you with advice and support
to hold certain data concerning your identity, contact details and general
health on our files. By subscribing for Personal Training you expressly
consent to LWFITNESS4ALL LTD having authority to keep
personal data for the duration of your subscription and for up to two years afterwards to assist us in providing you with the best possible service. For the avoidance of doubt, by subscribing for Online Personal Training you are not affecting any of your rights under the Data Protection Act 1998.
A person who is not party to the Subscription Agreement has no rights
under the Contracts (Rights of Third Parties) Act 1999.
LWFITNESS4ALL LTD may communicate with you via
electronic mail (“e-mail”). By providing an e-mail address to
lee@lwfitness4all.com, you consent to receiving e-mail communications
from lwfitness4all.com. You also accept that e-mail may not be a secure
and confidential means of communication. LWFITNESS4ALL LTD
will not be liable for any loss or damage suffered as a result of
communicating with you via e-mail.
These terms and conditions may be revoked, altered or added to from time
to time by LWFITNESS4ALL LTD, without prior notification to you. Any such
variations will be published on the website of www.lwfitness4all.com.
Prices are correct at time of being published and subject to change without prior notice. All services are to be paid for in full, in advance of the session commencing using any one of the payment systems specified. Cancellation of sessions must be made [twenty four (24)] hours in advance of the session start time. Failure to do so will result in a cancellation charge of equivalent value to 100% of the session value. Notification of cancellation relating to any Direct Debit must be given in writing and received by lwfitness4all no less than [one (1)] month before the cancellation date. Invoices are to be paid to lwfitness4all within [fourteen (14)] days of receiving notification.
These terms and conditions shall be governed by the laws of England and Wales and subject to the exclusive jurisdiction of the Courts of England.
